Pats still control Brian Waters' rights

AWOL Patriots G Brian Waters' 2012 contract has officially tolled to 2013, but ESPN Boston considers it unlikely Waters plays for the Pats "ever again."
And by extension, football, since the Pats have thus far proved unwilling to trade Waters or relinquish his rights. It's possible the Pats will have a change of heart after making Waters sit out in 2012, but there would be little-to-no trade interest in a soon-to-be 36-year-old guard who hasn't played a down of football in over a year.
