Yahoo! reported in May that the prosecution might only pursue a simple DUI charge because of the difficulty of proving manslaughter, but the state will start out aiming high. If convicted of DUI manslaughter, Stallworth would face a mandatory four-year prison sentence. He will be pleading not guilty.
