THE SPRINT SUPER BOWL SWEEPSTAKES
OFFICIAL RULES
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN.
The following promotion is intended for participants in the United States only and shall be construed and evaluated according to the laws of the United States. Do not proceed in this promotion if you are not a legal resident of the United States. Further eligibility restrictions are contained in the official rules (“Official Rules”) below.
1. PROGRAM DESCRIPTION: The “Sprint Super Bowl Sweepstakes” (the “Sweepstakes”) is sponsored by NBC Universal, Inc., 30 Rockefeller Plaza, New York, NY 10112 (the “Sponsor”). Sprint Communications Company, L.P. (“Sprint”) is presenter and not an official Sweepstakes Sponsor. The Sweepstakes is administered by Creative Zing Promotion Group, 100 E. Pine Street, Suite 201, Orlando, FL 32801 (the “Administrator”). Sweepstakes will commence at 12:01 am Eastern Time (“ET”) on Tuesday, October 14, 2008 and end at 11:59 pm ET on Wednesday, December 31, 2008 (the “Sweepstakes Period”). All times in the Sweepstakes refer to Eastern Time. All NFL-related trademarks are trademarks of The National Football League and used with permission of NFL Properties LLC. 2. ELIGIBILITY: The Sweepstakes is open only to legal permanent US residents physically residing in the 48 contiguous United States and the District of Columbia who are at least 18 years of age and not a minor in their state of primary residence at the time of entry. Officers, directors, agents, and employees of Sponsor, Sprint, Administrator, the NFL Entities and their respective parents, affiliates, subsidiaries, advertising and promotion agencies or any other entity involved in the development of this Sweepstakes (collectively, “Sweepstakes Entities”), and their immediate family members (parent, child, spouse, sibling and their respective spouses, regardless of where they reside) and/or those living in the same household of each, whether or not related, are not eligible to participate or win in the Sweepstakes. Entries must be received by the end of the Sweepstakes Period in order to be eligible. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void in Hawaii, Alaska and where prohibited or restricted by law. Sponsor reserves the right to verify eligibility qualifications of any entrant or winner.
3. HOW TO ENTER: Beginning on 12:01 am ET on Tuesday, October 14, 2008 participants may enter the Sweepstakes by visiting www.sprintsweeps.nbcsports.com (the “Sweepstakes Website”), clicking on Sweepstakes banner or link, and following the instructions to enter, including completing the official entry form in its entirety. All entries must be received by 11:59 pm ET on Wednesday, December 31, 2008. Limit of one (1) entry per unique email address or person during the Sweepstakes Period. Multiple entries during the Sweepstakes Period from the same person will be disqualified. Incomplete entries will be disqualified. Entries generated by a script, macro or other automated means will be disqualified. Normal Internet access and usage charges imposed by entrant’s online carrier will apply. Entries that are incomplete, illegible or corrupted are void and will not be accepted. Sponsor is not responsible for lost, late, stolen, incomplete, or otherwise misdirected entries or transactions that are processed late or incorrectly or are lost due to computer or electronic malfunction or other error. All entries become the property of Sponsor.
4. RANDOM DRAWING/WINNER NOTIFICATION: The potential winner (“Potential Winner”) will be selected in a random drawing conducted by the Administrator from among all eligible entries received, on or about January 2, 2008. Potential Winner will be notified by email at the email address provided at the time of entry within 72 hours from the time of the Winner’s (as defined below) selection. Potential Winner must accept the Grand Prize (as defined below) within five (5) business days of notification by either email or telephone. If any email notification is returned to Sponsor as undeliverable or if Winner does not accept the Grand Prize with five (5) business days of notification, he/she may be disqualified, the Grand Prize may be forfeited and an alternate Potential Winner may be selected, in Sponsor’s sole discretion. Potential Winner will be required to complete, sign, have notarized and return an Affidavit of Eligibility and Liability Release (“Affidavit and Release”) and a Publicity Release (unless prohibited by law) as directed by the Administrator. Failure to comply within the time period specified by the Administrator, with these Official Rules or the return of any prize/prize notification/prize correspondence as undeliverable may result in forfeiture of the Grand Prize and, at Sponsor’s discretion, selection of an alternate Potential Winner. Travel companion must complete a travel guest liability/publicity release prior to the Trip (as defined below). Grand Prize Winner’s travel companion must be of the age of majority in his or her state of residency or Grand Prize Winner must be travel companion’s parent or legal guardian and must complete and return all releases on behalf of minor. Prize will not be awarded until all such properly executed forms are returned.
5. ODDS OF WINNING: Odds of winning depend on the number of eligible entrants received.
6. PRIZE:
Grand Prize (1) | One (1) Grand Prize Winner (“Winner”) will be selected to receive: one (1) 4 day/3 night trip (“Trip”) for Winner and a guest to Tampa, FL to attend Super Bowl XLIII. The trip will consist of the following: (a.) round-trip coach air transportation for two (2) people from the major airport nearest Winner's residence to Tampa or Orlando, FL; (b.) three (3) nights standard hotel accommodations for Winner and his/her guest at a hotel selected by Sponsor (one standard room; double occupancy and room tax only); (c.) $1000 for ground transportation/spending money, issued to Winner in the form of a check and (d.) admission for Winner and a guest to attend Super Bowl XLIII. Total Grand Prize Approximate Retail Value (“ARV”): $10,000. |
Actual Grand Prize value depends on Winner’s place of residence and cost and availability of airfare and hotel at time of booking and travel and may be substantially higher or lower than estimated ARV. Winner and guest are responsible for obtaining the necessary travel documents. Sweepstakes Entities will not obtain travel insurance on behalf of any Winner or travel companion. Any costs of travel exceeding the allowance provided herein shall be the sole responsibility of the Winner. For the avoidance of doubt, the Winner shall be solely responsible for all expenses not specifically set forth herein, including but not limited to meals, gratuities, tips, taxes and incidentals. Travel dates are tentatively scheduled for January 30 – February 2, 2009. Trip must be taken on the dates specified by the Sweepstakes Entities in their sole discretion and failure to travel during the specified times will result in forfeiture of the Grand Prize. If a Winner lives within 200 miles of Tampa, FL, the Sweepstakes Entities reserve the right to substitute ground transportation for airfare, in their sole discretion and no compensation or substitution will be provided for difference in Grand Prize value. Sweepstakes Entities reserve the right to change travel dates and to substitute any or all of these portions of the Grand Prize for a prize of comparable or greater value should they become unavailable or impractical for any reason. ALL FEDERAL, STATE AND LOCAL TAXES, AND ANY OTHER COSTS, FEES AND EXPENSES, ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER. Winner cannot assign or transfer the prize to another person, except at the discretion of Sweepstakes Entities. If Grand Prize is awarded but unclaimed/forfeited by recipient, Grand Prize may not be re-awarded, in Sweepstakes Entities sole discretion. Sweepstakes Entities shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of Grand Prize due to reasons beyond Sponsors’ control, and are not responsible or liable for any expenses incurred as a consequence thereof. Sweepstakes Entities reserve the right to substitute a prize of equal or greater value in their sole discretion. In the event that a Grand Prize component is not available for any reason, or Winner chooses to take the Trip and/or attend Super Bowl XLIII with no guest, then the remaining elements of Grand Prize shall be awarded and shall constitute full satisfaction of Sweepstakes Entities’ prize obligation to Winner and no additional compensation will be awarded. Other restrictions may apply. The Grand Prize, and all portions of the Grand Prize, is awarded WITHOUT WARRANTY OF ANY KIND, express or implied, without limitation. Grand Prize Winner and travel companion must travel together on the same itinerary, including the same departure date, destination and return date. Sweepstakes Entities will not replace any lost or stolen tickets, travel vouchers or certificates. Once travel commences, no unscheduled stopovers are permitted; if an unscheduled stopover occurs, full fare will be charged from stopover point for the remaining segments, including return, of the trip. Sweepstakes Entities are not liable for any expenses incurred as a consequence of flight cancellation/delay. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Super Bowl XLIII admission may be subject to certain terms and conditions as specified by prize supplier. Location of seats to be determined by Sweepstakes Entities. Winner and guest agree to comply with all applicable stadium or arena regulations. Sweepstakes Entities will furnish an Internal Revenue Service Form 1099 to the Winner for the tax year in which the Grand Prize was won.
7. GENERAL RULES: Acceptance of prize constitutes permission to the Sponsor and its designees to use Winner's name, city, state, likeness, voice, biographical information and statements for purposes of advertising, promotion and publicity in any and all media, now or hereafter known, throughout the world in perpetuity without additional compensation, notification or permission, unless prohibited by law. By participating, entrant (i) agrees to release and hold Sweepstakes Entities, NFL Entities, their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and each of their respective directors, officers, employees, agents, shareholders, representatives and assigns (collectively, the “Released Parties”), harmless against any and all claims and/or liability arising in whole or in part, directly or indirectly, out of participation in the Sweepstakes or misuse, nonuse or use of any prize (including any travel or activity related thereto); (ii) waives all rights to claim punitive, incidental and consequential damages, attorney’ fees or any damages other than actual out-of-pocket costs incurred to enter; and (iii) agrees to be bound by these Official Rules and the decisions of the Sponsor which are final and binding on all matters relating to the Sweepstakes. Released Parties are not responsible for incomplete, lost, late, stolen, damaged, inaccurate, illegible, misdirected, garbled, delayed or undelivered entries; or for technical hardware or software malfunctions or failures of any kind, lost, unavailable network connections, or failed, incomplete, garbled or delayed computer transmission, which may limit an individual’s ability to participate. or CAUTION: Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law, including criminal prosecution. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. “Authorized account holder” of an email address is defined as the natural person who is assigned to an email address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email. Released Parties are not responsible for any technical, mechanical, printing, typographical, human or other error of any kind relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in the administration of the Sweepstakes, the processing of entries, the announcement of the Grand Prize or in any Sweepstakes-related materials; or for any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Sweepstakes. If for any reason this Sweepstakes is not capable of being run or implemented as planned, including, but not limited to, as a result of infection by computer viruses or bugs, tampering, unauthorized intervention, fraud, technical or other error or any other cause, occurrence or problem of any kind, which, in Sponsor’s sole judgment, is likely to or actually corrupts or affects the administration, security, fairness, integrity or proper play or conduct of the Sweepstakes (as determined by Sponsor in its sole discretion), then Sponsor reserves the right to cancel, terminate, modify or suspend all or any part of the Sweepstakes and the Grand Prize may not be awarded; except that Sponsor, in its sole discretion, reserves the right to pick the Potential Winner in a random drawing from among all eligible entries received by Sponsor up until the time of such cancellation, termination, modification or suspension, as applicable. Any changes will be posted on the Sweepstakes Website.
8. NO WARRANTIES: Sponsor makes no warranties covering any of the prize(s) furnished as part of this Sweepstakes.
9. GOVERNING LAW/DISPUTES: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant, Sponsor or the Released Parties in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of the State of New York without giving effect to any choice of law or conflict of law rules or provisions which would cause the application or the laws of any jurisdiction other than the State of New York. As a condition of participating in this Sweepstakes, Entrants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (e.g. costs associated with entering), and participant further waives all rights to have damages multiplied or increased. If any controversy or claim arising out of or relating to the Sweepstakes, the Official Rules, or the breach of any term hereof, cannot be otherwise resolved, it shall be resolved by binding arbitration conducted in the County of New York, and administered by Judicial Arbitration and Mediation Services (“JAMS”) in accordance with its Streamlined Arbitration Rules and Procedures or subsequent versions thereof (the “JAMS Rules”). The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be an experienced arbitrator licensed to practice law in New York. The decision of the arbitrator shall be binding, final and conclusive and shall not be appealable to any court.
10. PRIVACY POLICY: Any personal information supplied by you to Sponsor will be subject to NBC.com’s privacy policy posted at http://www.nbc.com/Footer/Privacy. By entering the Sweepstakes, you grant Sponsor permission to share your email address and any other personally identifiable information with the Sweepstakes Entities for the purpose of administration and prize fulfillment. Additionally, by opting-in to specific offers from any of the Sweepstakes Entities, Entrant's entry information will be subject to their respective privacy policies and terms of service and Entrant agrees to receive additional email communication from those companies. NBC will not sell, rent, transfer or otherwise disclose your personal data to any third party other than as explicitly described herein.
11. WINNER ANNOUNCEMENT/OFFICIAL RULES: For the name of the Winner or a copy of these Official Rules, send your request along with a stamped, self-addressed envelope to "Sprint Super Bowl Sweepstakes" Winner List/Rules, 100 E. Pine Street, Suite 201, Orlando, FL 32801. Requests for the name of the Winner must be received no later January 15, 2009. Vermont residents may omit return postage.
