GRAND PRIZE RANDOM DRAWING: On or about May 19, 2009, employees or representatives of Sponsors, whose decisions are final and binding, will conduct a random drawing to select one (1) potential Grand Prize Winner (as defined below) from all eligible entries received during the Sweepstakes Period. Odds of winning depend on number of eligible entries received.
GRAND PRIZE: Sponsor will award to the winner of the Grand Prize Random Drawing (the “Grand Prize Winner”) one (1) Grand Prize consisting of ten thousand dollars ($10,000) (“Cash Prize”) and a 2010 Preakness Stakes VIP Experience featuring a trip for Grand Prize Winner and one (1) guest (“Guest”) to the 2010 Preakness Stakes (the “Prize Event” and together with the Cash Prize, referred to herein as “Grand Prize”)) including 1) round-trip coach class air transportation for Grand Prize Winner and one Guest from major U.S. gateway airport nearest Grand Prize Winner’s residence (as determined by Sponsors) to a major gateway airport near the Prize Event (as determined by Sponsors), 2) three (3) days/two (2) nights hotel accommodations (standard room, double occupancy), as determined by Sponsors in their sole discretion, and 3) round-trip transportation between airport and hotel and Prize Event. Approximate retail value (“ARV”) of Grand Prize is ($15,000). Actual value may vary depending on city of departure and dates of travel. Trip must be taken within dates provided by the Sponsors. Due to the nature of television and sporting events, the dates and times of the Broadcasts, the 200 Preakness Stakes, and/or the Prize Event are subject to change. If any of these events is canceled for any reason or if for any reason this Sweepstakes is not capable of being run or implemented as planned, including, but not limited to, as the result of infection by computer viruses or bugs, tampering, unauthorized intervention, fraud, or any other cause of any kind, which, in Sponsors’ sole judgment, is likely to or actually corrupts or affects the administration, security, fairness, integrity or proper conduct of the Sweepstakes, then Sponsors reserve the right to cancel, terminate, modify or suspend all or any part of the Sweepstakes and the Grand Prize may not be awarded; except that Sponsors, in their sole discretion, reserve the right to pick a Grand Prize Winner in a random drawing from among all eligible entries received by Sponsors up until the time of such cancellation, termination, modification or suspension, as applicable.
WINNER NOTIFICATION: Potential Grand Prize Winner will be notified by phone and/or email. Sponsors will make two (2) attempts to contact the potential Grand Prize Winner, at the phone number or email address provided online or at the mobile device number used to enter, within seventy-two (72) hours from the time of the potential Grand Prize Winner’s selection. If Sponsors are unable to reach a potential Grand Prize Winner via phone or email within this time frame, he/she may be disqualified and an alternate Grand Prize Winner may be selected in a random drawing from among all remaining eligible entries at Sponsors’ sole discretion. Grand Prize Winner will be required to complete, sign, have notarized and return an Affidavit of Eligibility and Liability Release ("Affidavit and Release") and a Publicity Release (unless prohibited by law) within seven (7) days of notification by Sponsors. If the Affidavit and Release and the Publicity Release are not returned within such time period, the Grand Prize may be forfeited and an alternate Grand Prize Winner may be selected at random from among all eligible non-winning entries received. CONDITIONS OF ENTRY: Sponsors reserve the right to disqualify entrants who violate these Official Rules or interfere with this Sweepstakes in any manner. Entrants agree to release and hold harmless Sponsors and Sweepstakes Entities and their respective parent companies, subsidiaries, affiliates, and agencies, including advertising and promotion agencies, and all of their respective employees, officers, directors, shareholders, and legal counsel (collectively, the “Released Entities”), from any and all liability, claims, actions, injury, loss or damage of any kind resulting from any entrant’s participation in this Sweepstakes or from their acceptance, use or misuse of the Grand Prize (including any travel related thereto) awarded hereunder. The Sponsors reserve the right to verify eligibility qualifications of any winner. The value of the Grand Prize represents the Sponsors’ good faith determination of the maximum retail value thereof. For Form 1099 reporting purposes, the Grand Prize Winner shall be bound by such good faith determination. Except where prohibited, Grand Prize Winner grants to Sponsors and their advertising agencies the right to use, and publish his or her proper name, likeness, voice, opinions, biographical information and state and announce on-air Grand Prize Winner’s name, home city and state in any and all media, now or hereafter known, throughout the world in perpetuity without additional compensation, notification, permission, approval or consent.
Entrants enter at their own risk. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsors in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of the State of New York without giving effect to any choice of law or conflict of law rules or provisions which would cause the application of the laws of any jurisdiction other than the State of New York. If any controversy or claim arising out of or relating to the Sweepstakes, the Official Rules, or the breach of any term hereof, cannot be otherwise resolved, it shall be resolved by binding arbitration conducted in the County of New York, and administered by Judicial Arbitration and Mediation Services, Inc.
